1. Acceptance of Terms and Conditions

By downloading, accessing, or using the Tagg-N-Go app (the “App”) provided by Tagg-N-Go Car Wash LLC, you agree to comply with and be bound by the following Terms and Conditions (“Terms”). If you do not agree with these Terms, please do not use the App.

2. Use of the App

2.1. Eligibility: You must be of legal age to enter into a contract and have the legal capacity to use the App. If you are using the App on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms.

2.2. User Account: Some features of the App may require you to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.3. Prohibited Activities: You agree not to engage in any of the following activities while using the App:

– Violating any applicable laws or regulations.

– Using the App for fraudulent or unauthorized purposes.

– Harassing, threatening, or harming other users or Tagg-N-Go’s employees.

2.4 Connectivity: Tagg-N-Go is not responsible for lack of cell phone coverage or connection limitations that may prevent use on any given day. Refunds or credits will not be provided due to poor cell phone connectivity or other personal device limitations.

3. Purchases and Payments

3.1. Product Listings: The App may display products available for purchase. Product descriptions, prices, and availability are subject to change without notice.

3.2. Payment Information: You must provide valid payment information to Tagg-N-Go for purchases made through the App. You authorize Tagg-N-Go to charge your chosen payment method for all applicable fees.

3.3. Discounts and Coupons: No refunds or credits will be provided for any discounts or coupons. Discounts and Coupons have no cash value. Additional member benefits and offers, including free offers, are subject to availability and continued membership good standing. Some discounts may be applicable only to new users. Promotions that indicate a monthly price are deemed to be a dollar amount subtracted from the current membership pricing. For Lifetime discounts, the coupon or discount off the current membership pricing is forever, however, the base price is always subject to adjustments as necessary but not without notice.

3.4. Membership Use: Various membership plans are available for purchase through the app. As a Tagg-N-Go App member, you understand that your payment information will automatically be charged each month until the Membership is canceled or terminated.

3.6. Loyalty Use Program: All customers, including subscription-based members and single wash retail users, are automatically enrolled in the Tagg-N-Go Loyalty Rewards program upon completion of account setup within the app. Tagg Tokens are earned at a consistent rate in relation to qualified in-app spending.

3.8. Order Confirmation: An order through the App constitutes an offer to purchase the product(s). Appropriate shipping information must be provided. Tagg-N-Go reserves the right to accept or reject any order. Order confirmation does not signify acceptance of your offer.

3.9. Availability: Not all product offerings or services may be available at all Tagg-N-Go locations. Tagg-N-Go reserves the right to close locations due to inclement weather, holidays, equipment maintenance, unforeseeable natural disasters, governmental requirements, location upgrades, or any other reason to maintain the facilities as a going concern.

4. Refunds and Credits

4.1. Refunds: Tagg-N-Go will make reasonable efforts to address any wash concerns promptly. Retail washes that are completed as intended will not be issued refunds for any reason.

4.2. Credits: Referral credits have no cash value and are not redeemable for cash. The Tagg Tokens and the Referral promotion are only available in the app.

4.3. Returns: Please refer to Tagg-N-Go’s Return Policy for information on returns, exchanges, and refunds specific to retail goods.

5. Privacy and Data Security

5.1. Privacy Policy: Your use of the App is subject to Tagg-N-Go’s Privacy Policy, which governs the collection and use of your personal information.

5.2. Security: You are responsible for maintaining the security of your account credentials and ensuring the confidentiality of your account information. The app is per user and a user’s 1 (single) mobile device. Sharing login information across multiple devices is prohibited. No more than 1 device per user is permitted.

6. Changes to Terms and App

Tagg-N-Go reserves the right to change these Terms and the App at any time, with notice to you. Continued use of the App after such changes constitutes your acceptance of the modified Terms.

7. Termination

7.1. Membership Cancellations: Deleting or otherwise removing the app from your mobile device is NOT considered a cancellation request for memberships. Refunds will not be provided for users who simply delete the app and do not follow the cancellation process outlined in the membership terms and conditions.

7.2. Tagg-N-Go Service Termination: Tagg-N-Go reserves the right to terminate or suspend any products, offerings, or services available in the app at any time and for any reason.

7.3. Tagg-N-Go App Termination: Tagg-N-Go reserves the right to terminate or suspend your access to the App at any time for violations of these Terms or for any other reason determined by Tagg-N-Go.

8. Disclaimer of Warranties

8.1. APP Warranties: The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2. VEHICLE ATTACHMENTS AND CAUTIONS during wash use: Users are responsible for taking care to observe all caution signs and warnings at Tagg-N-Go locations, including but not limited to signage regarding automobile accessories and attachments. Users will be held liable for damage caused to Tagg-N-Go locations for failure to obey all signage. Failure to comply with site signage will result in immediate cancellation of membership.

9. Limitation of Liability

To the maximum extent permitted by law, Tagg-N-Go shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages or any loss of profits or revenues arising out of or related to your use or inability to use the App.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the States of Utah, Nevada, and Idaho. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the said courts, and you consent to the personal jurisdiction of such courts.
